This privacy policy is applicable to the French version of the Ogier Internet site accessible at www.ogier.fr (hereinafter referred to as the “Site”). In the context of the use of the Site,
Ogier (hereinafter referred to as “Ogier”) is likely to collect certain personal information about you, in compliance with the provisions of Regulation 2016/679/EU known as the General Data Protection Regulation (GDPR).
Ogier is responsible for the processing of your personal data in accordance with the General Data Protection Regulation.
This Confidentiality Policy informs you of the methods of collection, processing and use of your personal data (“Personal Data”) and of your rights with regard to the protection of such data.
Please read this Privacy Policy carefully before using the Site. If you do not want us to collect your data in accordance with this Privacy Policy, please be aware that we may not be able to fulfill some of your requests.

1. WHAT TYPE OF PERSONAL DATA DO WE COLLECT?

We collect your Personal Information only for the purposes set forth in Section 3 and whenever you use any of the features or services offered by the Site.
The categories and amount of Personal Data collected for the use of features and services may be updated and evolve as our services and activities change.
Subject to applicable legal requirements, we may use various technologies that collect and provide information about how you access and use our Site. We may also use demographic information, which we may obtain from third parties, such as Google or social networks on which you are registered (“Usage Information”). Usage Information may include the pages you viewed, when you viewed them, information about any beverages or other content you accessed or provided, the language in which you viewed our Site, including demographic information about you (such as your age, gender, and interests, if any) and the pages you viewed before viewing that page, etc.

2. HOW AND WHY DO WE USE COOKIES AND TRACKING TECHNOLOGIES?

We use tracking technologies, such as cookies, IP addresses or logs. These tracking technologies help us tailor our Site to your needs.

3. FOR WHAT PURPOSES DO WE USE YOUR PERSONAL DATA?

We collect Personal Data about you for the following purposes
Respond to your requests for services or fulfill a contract: When you register or subscribe on the Site, your Personal Data is used to provide you with the features and services to which you have subscribed and to provide you with the benefits and privileges that generally flow from your registration (e.g., receiving the communications you selected at the time of registration, being invited to events, entering contests, fulfilling your order for Products etc.);
To send you operational or administrative communications: (e.g., a confirmation email when you sign up (or unsubscribe) for a service or feature), as well as certain service-related notifications (e.g., notifications of updates to our privacy notices, disruptions to features or programs on our Site, changes affecting our online services or IT support policies, or other related changes, etc.).
To allow us to send you marketing communications, where you have given us your consent:
In addition to the purpose for which you have provided us with your Personal Data, you may be asked to consent (e.g., by means of a checkbox) to your Personal Data being used for an activity or service different from the primary activity or service you requested. For example, if you enter a contest or other promotional activity, you may also be invited to subscribe to newsletters or alerts sent by the Site hosting the promotional activity or by other websites. If you consent to receive our targeted advertisements, emails and text messages we will use your Personal Information for this purpose.
When you use the “Send to a Friend” feature (if available): the Personal Information collected will be used only once to send the message and will be deleted in accordance with applicable local law;
When you use a QR Code or equivalent application displayed on Ogier products: we will use your Personal Data to send you more information about the products with the QR Code or similar application or about other products;
Because it is also in Ogier’s legitimate interest to serve you better:
Subject to obtaining your consent where required, we may combine, update or consolidate your Personal Data collected through our Site with data we receive from third party and external sources. For example, we may combine purely demographic or survey information (e.g., age, gender, family information, and other interests, etc.) that is not linked to any of your Personal Information with Personal Information collected through our offerings (e.g., at the time of account registration).
We may use the combined information and/or demographic information mentioned above for our internal marketing and demographic studies and for the purposes of continually improving, customizing and adapting the products and services we provide to you to better meet your needs. Some of the tools we use may involve automated decision making as permitted by applicable law.
To manage and track your requests and comments via our “Contact Us” form: for example, in connection with the performance of a contract.
We will ensure that your Personal Information remains accurate and up-to-date or needs to be supplemented with additional information you have provided. We will also strive to avoid duplicating our database by checking each of your interactions with us and/or our affiliates and verifying whether your Personal Information is still accurate or needs to be supplemented or updated with additional information you have provided.
We may analyze your activities and browsing patterns on the Site to better understand your preferences and interests and to tailor our communications to your tastes and preferences, unless you object as described in Section 9 of this Privacy Policy.
We may also use automatic decision-making processes, including for the purpose of fulfilling a contract.
Please note that the automatic tools used are regularly checked to ensure that Personal Data is processed lawfully. Specific measures, such as data minimization, are put in place when creating profiles. You may also challenge the outcome of the automatic decision by sending an email to the address indicated in Section 11 below and request additional information.

 

4. WHAT HAPPENS IF YOU REFUSE TO PROVIDE US WITH YOUR PERSONAL DATA?

If you refuse to submit the Personal Data requested, you may not be able to participate in certain activities, enjoy certain personalized features, or the Site and special services offered to you may be limited. For example, if you refuse to provide your email address, you will not be able to receive our newsletters or register with the Site. On the other hand, you are not obliged to provide us with your Personal Data to browse our Site and to find out about Ogier and our products. In any case, we will always tell you which Personal Data are necessary to benefit from a service.

5. WHY AND TO WHOM DO WE DISCLOSE YOUR PERSONAL DATA?

To Ogier and the Advini Group
For the purposes mentioned in Section 3, your Personal Data may be transmitted to the various subsidiaries throughout the world of the Advini Group.
To third parties
We may transfer your Personal Data to third parties, but only in the following cases
For marketing purposes if you have given us your consent to do so.
For support purposes: We may use service providers, agents or contractors to provide us with support and maintenance services for our Site and to assist us in administering the Site or the various features, programs and promotions contained therein. These third parties agree to provide the same levels of security for your Personal Information as those offered by Ogier;
For joint and co-sponsored programs and promotional purposes: When we conduct joint or co-sponsored promotions on our Site in partnership with other companies or other trusted third parties, and as part of that event we collect and process Personal Information, we may share your Personal Information, subject to obtaining your consent where required by law. In the event that your Personal Information is collected by, or transmitted to, a company other than Ogier as part of this promotion, we will inform you at the time of collection of your Personal Information;
For legal and security purposes: We may also disclose your Personal Information if we are required to do so by law or if we believe, in good faith, that such disclosure is reasonably necessary to comply with legal process, respond to claims, or protect the safety or rights of Ogier; their customers or the public;
In the event of a merger or acquisition of all or part of Ogier by another company or in the event of the sale or transfer by Ogier of all or part of its business, the acquirer would have access to information that could include Personal Data, subject to applicable law. Similarly, some of your Personal Information may be transferred in the context of a restructuring, insolvency or similar event, if permitted by and in accordance with applicable law.

6. WHERE, HOW AND WHY YOUR PERSONAL DATA MAY BE TRANSFERRED OUTSIDE THE EUROPEAN UNION

Given the international dimension of the Advini Group, and for the purposes mentioned above, your Personal Data may be transferred abroad and in particular to countries that have data protection laws of a different level than the laws of the country in which you have submitted your Personal Data. It is also possible that your Personal Data may be transferred from one Advini Group company to another and that these two companies are located in different countries. Ogier and Advini take appropriate measures to ensure the security of Personal Data, both during the transfer and at the destination, by implementing contractual clauses as prescribed by the European Commission, in accordance with applicable law.
Where our service providers for the operation of the Site are based in the United States, transfers of Personal Data to such service providers are made in accordance with applicable law and are based on standard contractual clauses, as prescribed by the European Commission, or on the Privacy Shield. These service providers are also bound by a contract that guarantees a high level of privacy protection and that requires them (among other stipulations) to act only on Ogier’s instructions and to constantly implement all technical measures necessary to maintain the security of your Personal Data.

 

7. HOW LONG DO WE KEEP YOUR PERSONAL DATA?

We will store your Personal Data in our databases for as long as your account is active, for the duration of the contract we have with you, or as needed to provide you with the services you request, to answer questions, or to resolve problems or provide enhanced and new services. We may also retain your Personal Data in accordance with our internal retention procedures to the extent necessary to comply with our legal and regulatory obligations, to resolve disputes and to obtain performance of our contracts.
We may also retain Personal Information about you after you have ceased to use the services of our Site, as required by law.

8. HOW DO WE SECURE YOUR PERSONAL DATA?

Ogier will take all necessary technical and organizational measures to protect the confidentiality and security of your Personal Data collected through the Site. These measures include, but are not limited to: (i) storing your Personal Data in secure operating environments that are not accessible to the public and are only accessible to authorized Ogier personnel and our agents and contractors and (ii) verifying the identity of registered users before they can access your Personal Data.

9. WHAT ARE YOUR RIGHTS?

If your Personal Data has been processed with your consent, you have the right to withdraw your consent at any time without affecting the consent given before the withdrawal.
You may request access to your Personal Information.
You may request that your Personal Information be corrected if it is inaccurate, incomplete or out of date.
You may request that your Personal Data be deleted if: (i) the Personal Data concerning you is no longer necessary for the purpose of the data processing, (ii) you have withdrawn your consent to the processing of the data based solely on such consent, (iii) you have objected to the processing of the data, (iv) the processing of your Personal Data is unlawful, (v) the Personal Data needs to be deleted in order to comply with a legal obligation applicable to Ogier. Ogier will take reasonable steps to inform other Advini Group entities that such erasure has been carried out.
You may request restriction of processing: (i) in the event that you dispute the accuracy of your Personal Data in order to allow us to verify such accuracy, (ii) if you wish to restrict your Personal Data rather than delete it in the event of unlawful processing, (iii) if you wish Ogier to retain your Personal Data because you need it for your defense in a legal action, (iv) in the event that you have objected to the processing but Ogier conducts an investigation to verify whether it has legitimate grounds for such processing that may override your own rights, if the processing is based on Ogier’s legitimate interests
You may request the portability of the Personal Data you have provided to us if the processing of the Personal Data is based on your consent or on the performance of a contract and is carried out in an automated manner (which excludes paper files).
You will always have the choice not to provide us with your Personal Data. In this case, you may be limited in the activities and features we will be able to provide to you.
You have the right to object to the processing of your Personal Data at any time for direct marketing purposes, for marketing purposes based on profiling or if the data processing is based on Ogier’s legitimate interest (unless we can justify the existence of a legal obligation).
You also have the right to give general and specific instructions on the fate of your Personal Data after your death.

 

10. HOW DO WE HANDLE PERSONAL DATA FROM CHILDREN?

Our Site is not intended for children under the legal drinking age (“Minor”), so we do not knowingly collect any Personal Data from Minors. You must be at least eighteen years old to create an account and to participate and transact on our Site. In the event that we are notified or become aware that a Minor has submitted Personal Data to us through our Site, we will delete such Personal Data.

11. HOW TO EXERCISE YOUR RIGHTS, CONTACT US OR MAKE A COMPLAINT TO THE CNIL?

We undertake to respond within a maximum of one month from receipt of your request. This period may be extended by two months due to the complexity and number of requests.
Please note that you can also submit a complaint to the Supervisory Authority of the country in which you are located if you have any doubts about the conditions under which Ogier processes your Personal Data.
